Prenuptial Agreement In Kaley Cuoco Divorce Might Not Hold Up

Actress Kaley Cuoco is most well-known for her role on the TV comedy “The Big Bang Theory,” but more recently has been making headlines for her divorce from tennis star Ryan Sweeting. Like most smart couples in Oregon, the two signed a prenuptial agreement before tying the knot. However, Sweeting has since made requests during the divorce process that fall outside of the terms described in the prenup.

Cuoco was the one to file for divorce in 2015 after apparently becoming fed up with Sweeting’s addiction problems. In response, Sweeting requested spousal support, an action that is not supported by the prenup. Since her ex filed the petition for support, Cuoco has not expressed much worry. Instead, she appears confident that the terms of her prenup will be upheld.

While it does take substantial evidence to have a prenuptial agreement found invalid, some believe that Sweeting could have a fair argument. At the time that the agreement was signed, Sweeting was in overall good health. Now, he suffers from a variety of injuries that make it difficult for him to continue to support himself financially as a professional tennis player. Since the injuries occurred during the course of the couple’s marriage, some believe that he will choose to argue that the circumstances are very different, and that the agreement no longer applies.

It is not clear if different life circumstances are enough to have a judge completely invalidate a prenuptial agreement, as the simple act of filing for divorce indicates at least one different circumstance from the time that it was signed. In general, before a family law judge in Oregon will invalidate a prenup, he or she must be presented with compelling evidence. Still, this does not negate the exceptional range of benefits and protections that prenuptial agreements afford soon-to-be married couples.
