We know that restraining orders can be the first step to safety

| Nov 14, 2014 | Family Law |

We understand the sensitive nature of acts of violence between loved ones. Often, one party may be uncertain of his or her options and don’t know what steps can be taken for self-protection. In Oregon, restraining orders are often the first step to securing a safe environment for a victim of domestic abuse or violence.

Making the initial step to seek help is a monumental move for any victim of domestic violence. Whether the suspected violence occurs between a married couple or those who have just started dating, a restraining order can offer needed protection. These are usually issued following a report made to police about an incident, although this is not always the case.

Additionally, those who have children have additional options to ensure that can offer an additional measure of protection. A special restraining order authorized by the Family Abuse Prevention Act forces the alleged abuser to not only stay away from that individual but to also keep away from the children. If the abuser is a spouse or live-in boyfriend or girlfriend, he or she may also be ordered to temporarily leave the residence.

Victims may be either male or female, and the same goes for those accused of committing the abuse. Any violation of a restraining order could potentially put that individual behind bars, further ensuring the safety of any alleged victims. Seeking a restraining order against a loved one can be confusing and difficult, but victims of abuse have the right to seek help in order to remain safe. We know what it takes to make sure that a restraining orders are upheld in Oregon, even if the suspected abuser attempts to have it struck down.
